When Governor Phil Murphy declared a State of Emergency and Public Health Emergency on March 9, a number of state offices shuttered that New Jerseyans rely on to conduct essential oversight and share information with the public. Among these was the New Jersey Department of Environmental Protection (NJDEP) and, notably, the department’s Office of Record Access (ORA), which buyers in commercial real estate transactions need to access in order to make informed decisions about a property’s environmental health and history.

To say a lot has changed over the past couple of months would be a major understatement. Every one and every industry has been impacted in some significant way. There has been no shortage of questions and businesses, organizations and industry professionals have worked to share helpful information during this challenging time.

This month, firm principal, Ken Morgan, Esq., participated in a two-part webinar coordinated by the Jewish Federation of Southern New Jersey. He joined a number of peers to discuss and answer questions regarding real estate in this “new” normal world.

Ken spoke about a number of the challenges facing buyers and sellers, including home inspections, back logs, financingand 30-day contract extensions for closing relating to COVID-19.

A few key matters Ken discussed included the DEP’s Records Office’s closure and related inability to complete environmental inspections, delays in obtaining Certificates of Occupancy and prevalent lease re-negotiations about rent deferrals and/or waivers between landlords and tenants as a result of “stay-at-home” orders.

What came out of both webinars was that many of the same issues faced in the residential market are also prevalent in today’s commercial real estate transactions. When asked for key tips to keep in mind, Ken’s advice is to be alert, flexible, patient and focus on your key relationships.

This past November, Ken was appointed to the BCSJ Board of Directors. An active member of BCSJ for more than 10 years, he is a strong proponent of the organization’s goals.

The list is compiled by the votes of thousands of readers in the community. Marijuana Reform Presents Unique Commercial and Industrial Real Estate Investment Opportunities

Governor Phil Murphy campaigned on a pledge to fully legalize marijuana in New Jersey.  On January 23, 2018 he signed an Executive Order directing a complete review of New Jersey’s existing medical marijuana program within 60 days, which sets the stage for legalizing recreational marijuana.  Presently, only medical marijuana is legal under a New Jersey law enacted in January 2010.  Likely marijuana reform presents unique real estate investment opportunities and will probably increase the demand for commercial and industrial real estate.  However, there are significant risks that must be carefully considered before making any investment decisions, including criminal and civil liability (including property seizure) if federal laws are enforced, and a limited number of potential lenders and buyers.

Kenneth M. Morgan announces the formation of Morgan Law LLC in Cherry Hill, NJ on February 1, 2015. Morgan will continue to concentrate his practice on real estate, finance and business counseling and assist his clients with a wide variety of real estate transactions, including acquisitions, sales and leasing. Morgan was previously a Partner with Hyland Levin LLP and, prior to that, an Associate in the real estate department at Ballard Spahr LLP. Morgan received a J.D. with honors from Rutgers Camden Law School in 2002, an MBA from Drexel University in 1994 and a B.A. from the University of Pennsylvania in 1989.
